
The – Wolfgang Sigg GmbH, Zi.-u. Wohnungsvermittlung - MrLiving, Mitwohnzentrale (in the following referred to as MWZ) will provide the client/tenant with information about currently available rental accommodation which was previously unknown to the client. If the client has been informed of any of these properties by another source before, he or she should report this to MWZ immediately and submit a copy of the respective information.
The information and offers are confidential. In case of misuse or unauthorized use of data, the client will be held responsible for payment to the MWZ of the amount of commission which would have been owed if the rental contract had been normally finalized. The MWZ merely provides the information regarding accommodation and the opportunity to make a rental contract. The obligations of the rental contract are solely the responsibility of the tenant and the landlord. MWZ cannot be held responsible for any of the parties named in a contract in the event of a violation or breach of the contract.
In the case of finalization of an oral or written contract with one of our landlords, the client has to inform MWZ immediately (at the latest 24 hours after the agreement). If the information provided by the MWZ results in a different rent contract from that planned, or an additional contract being made, then commissions are due to the MWZ for each of these rent contracts that were finalized on the base of data originally given by the MWZ. finalized on the base of data originally given by the MWZ. We charge you a commission only if we were able to provide you with an apartment. As soon as a rent contract has been made by word of mouth or in writing, the commission of one (1) months rent plus 19% VAT, i.e. 119% of the monthly rent is immediately due to the MWZ.
As the basis for calculating the commission, the inclusive rent (including extras etc.) is applicable, unless the landlord has specified the basic price and these extras, in which case the basic price is used to calculate the commission. The rent price stated in our information is valid; any later changes in the monthly price do not alter our commission.
For rental contracts shorter than 6 months, the MWZ voluntarily grants the payment of the commission in the form of progressive rates (see table below) made up of installments of the full commission.
The full commission payable to the MWZ depends on the full duration of time spent in the property and is calculated according to the table below.
We charge:
up to 1 month 25 % + VAT. = 29,75 % of monthly rent
up to 2 month 40 % + VAT. = 47,6 % of monthly rent
up to 3 month 55 % + VAT. = 65,45 % of monthly rent
up to 4 month 70 % + VAT. = 83,3 % of monthly rent
up to 5 month 85 % + VAT. = 101,15 % of monthly rent
up to 6 month 100 % + VAT. = 119,0 % of monthly rent
more than 6 month 100 % + VAT. = 119,0 % of monthly rent
If any extension of the period of tenancy, together with resulting claim for the additional part (installment) of the full commission, is concealed from the MWZ, then our voluntary arrangement for payment of only part of the full commission becomes void. The client/tenant has to inform the MWZ of any such rental prolongation up to 6 months. Thus the full duration of this prolonged rental contract retroactively becomes the basis for calculating the commission owed to the MWZ.
In case of early departure or termination of the rental contract, MWZ cannot be held responsible, irrespective of who terminated the rental contract and on which legal basis this was terminated. The MWZ’s claim of due payment of commission according to the duration of the original rental contract is not waivered. Only in cases where it has been proven that the landlord did not or could not fulfill his obligations as declared in the rental contract and for this reason caused a premature termination of the rental contract, can a claim for partial refunding of the commission be considered.
